Terms and Conditions

Preamble

These General Sales Conditions (hereinafter "GSC") define the terms and conditions under which YOU Urban Spa, Société à responsabilité limitée, with its registered office at 148 AVENUE ACHILLE PERETTI 92200 NEUILLY-SUR-SEINE, registered with the Nanterre Trade and Companies Register under SIRET number 983 994 005 00012 (hereinafter "The Spa"), offers its services to its customers (hereinafter "The Customer(s)").

Any reservation or purchase of services at The Spa implies the Customer's full and unreserved acceptance of these GSC. The Customer acknowledges having read these GSC prior to any reservation or purchase.

The Spa reserves the right to modify these GSC at any time. The applicable GSC are those in force on the date of the service reservation or purchase.

Article 1: Services Offered

The Spa offers a range of wellness, beauty, and relaxation services, including but not limited to: [list main types of services, e.g., massages, facials, body treatments, hydrotherapy, nail services, waxing, use of spa facilities (head spa).

Detailed descriptions of each service, including their essential characteristics, duration, and prices, are available on The Spa's website www.you-urbanspa.com/, in its brochures, and at its reception desk.

Article 2: Prices

2.1. All prices are indicated in Euros (€) and include all taxes (TTC), including VAT at the applicable rate on the day of the service.

2.2. The Spa reserves the right to modify its prices at any time. However, services will be invoiced at the rates in force at the time of the Customer's reservation or purchase.

2.3. Gift vouchers, special offers, or promotional packages have specific validity periods and conditions, which are clearly stated at the time of purchase. These cannot be combined with other offers unless explicitly stated.

Article 3: Reservations and Appointments

3.1. Reservations can be made:

  • Online via The Spa's website: www.you-urbanspa.com/fr 

  • By telephone: 01 80 88 14 81

  • In person at The Spa's reception desk.

3.2. All reservations are subject to availability. The Spa will confirm the reservation by [e.g., email, SMS] upon successful booking.

3.3. For certain services or packages, a deposit or full prepayment may be required at the time of reservation. This will be clearly indicated during the booking process.

3.4. The Customer is responsible for providing accurate and complete personal information during the reservation process.

Article 4: Payment Terms

4.1. Payment for services can be made by:

  • Credit/Debit Card (Visa, MasterCard, Amex, etc.)

  • Cash (within legal limits)

  • Gift Vouchers issued by The Spa

 

4.2. Full payment is due at the time of the service, unless a prepayment or deposit was made during reservation.

4.3. In case of late payment (for services provided on credit, e.g., corporate accounts), late payment penalties equal to three times the legal interest rate in force, plus a lump sum compensation for recovery costs of €40 (Article L. 441-10 of the Commercial Code), will be applicable from the day following the due date mentioned on the invoice.

 

Article 5: Cancellation and Modification Policy

5.1. Cancellation by the Customer:

  • Any cancellation or modification of an appointment must be notified to The Spa at least 3 hours in advance.

  • For cancellations made within this timeframe, any deposit paid will be refunded or carried over to a new appointment.

  • For cancellations made less than 24 hours in advance, or in case of a no-show, The Spa reserves the right to charge 50% of the service price, the full deposit, or the full service price.

  • Gift vouchers will be considered used in full for no-shows or late cancellations without valid justification.

5.2. Late Arrivals:

  • Customers are requested to arrive at least 10 minutes before their scheduled appointment to allow for check-in and preparation.

  • Late arrival may result in a reduction of the service duration to avoid delays for subsequent appointments. No price adjustment will be made in such cases.

  • If a customer is more than 10 minutes late, The Spa reserves the right to cancel the appointment and apply the late cancellation policy (see 5.1).

5.3. Cancellation by The Spa:

  • In exceptional circumstances (e.g., unforeseen staff unavailability, technical issue), The Spa reserves the right to cancel or reschedule an appointment. In such cases, The Spa will inform the Customer as soon as possible and offer a full refund or the option to reschedule.

 

Article 6: Health and Safety

6.1. The Customer must inform The Spa of any health conditions, allergies, injuries, pregnancy, or medical treatments that may affect the chosen service. This information is confidential and crucial for the safety and effectiveness of the treatments. The Spa declines all responsibility for any adverse reactions resulting from undisclosed health information.

6.2. The Spa reserves the right to refuse or modify a service if it deems it unsafe for the Customer's health or well-being, or if the Customer's behavior is deemed inappropriate.

6.3. Customers must comply with The Spa's internal rules and regulations, displayed within the premises, regarding hygiene, conduct, and use of facilities.

 

Article 7: Liability

7.1. The Spa commits to providing services with care and diligence, in accordance with industry standards.

7.2. The Spa cannot be held responsible for the loss, theft, or damage of personal belongings left unattended on its premises. Lockers are provided for this purpose, and customers are encouraged to use them and keep their valuables secure.

7.3. The Spa's liability for any damage directly attributable to a fault on its part is limited to the price of the service concerned.

 

Article 8: Intellectual Property

8.1. All content on The Spa's website, brochures, and promotional materials (texts, images, logos, designs) is the exclusive property of The Spa and is protected by intellectual property laws. Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

Article 9: Personal Data Protection

9.1. The Spa collects and processes personal data from its Customers in accordance with the General Data Protection Regulation (GDPR) and French data protection law (Loi Informatique et Libertés).

9.2. The data collected is used for reservation management, service delivery, billing, and, with the Customer's consent, for sending promotional offers.

9.3. Customers have the right to access, rectify, erase, restrict processing, object to processing, and data portability of their personal data. To exercise these rights, Customers can contact The Spa at info@you-urbanspa.com.

9.4. More details on The Spa's personal data processing policy are available in its Privacy Policy, accessible on its website info@you-urbanspa.com.

Article 10: Complaints and Mediation

10.1. Any complaint regarding a service must be addressed in writing to The Spa within 7]days of the service date, by registered mail with acknowledgment of receipt to 148 ave Achille Peretti Neuilly sur seine or by email to info@you-urbanspa.com.

10.2. In the event of an unresolved dispute between The Spa and the Customer, the Customer may have recourse, free of charge, to a consumer mediator in accordance with Article L. 612-1 of the French Consumer Code. The contact details of the mediator The Spa uses are: Name and contact details of your chosen mediator, e.g., AME CONSO, www.mediationconso-ame.com, 197 Boulevard Saint-Germain - 75007 PARIS.

10.3. Customers residing in a European Union country may also use the European Online Dispute Resolution (ODR) platform: European Online Dispute Resolution Platform.

 

Article 11: Applicable Law and Jurisdiction

11.1. These GSC are governed by French law.

11.2. In the absence of an amicable resolution or mediation, any dispute arising from the interpretation or execution of these GSC shall be submitted to the competent courts of Nanterre or the jurisdiction where the Customer is domiciled, in accordance with applicable legal provisions.
